Agreement to the Terms and Conditions of Sale and Use; Signature Distributor Purchase Order Portal.
These Terms and
Conditions of Sale and Use (the “T&C's”) apply to the Signature Distributor
Purchase Order Portal (the “Signature-DPOP”) located at www.signaturecontrolsystems.com, and all associated sites linked to www.signaturecontrolsystems.com by Signature, its subsidiaries and
affiliates, including Signature sites around the world (collectively, the
“Site”). The Portal is the property of Signature Control Systems Inc.
(“Signature”) and its licensors.
BY USING THE PORTAL, YOU AGREE TO
THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE PORTAL.
Signature reserves the right, at its
sole discretion, to change, modify, add or remove portions of these T&C's,
at any time. It is your responsibility to check these T&C's periodically
for changes. Your continued use of the Signature-DPOP following the posting of
changes will mean that you accept and agree to the changes. As long as you
comply with these T&C's, Signature grants you a personal, non-exclusive,
non-transferable, limited privilege to enter and use the Signature-DPOP.
Shipping & Return
·
All
orders ship via UPS. Currently the Signature-DPOP does not accept orders placed
outside of the United States and does not ship to locations outside of the United
States.
·
Shipments
to a PO Box are not allowed.
·
Shipping
rates vary based on distance, weight and the shipping method.
·
Final
shipping rates and tax (if applicable) will be calculated during order
processing.
Signature
will accept returns of unused merchandise for up to 30 days from purchase for a
full credit. Upon the following conditions:

Proof
of purchase (original sales receipt or packing slip, invoice) is required for
reimbursement.
·
Items
should be in their original product packaging.
·
If
the item that you are returning was due to an error by Signature.
·
Items
must be received in a new / unused condition.
·
Items
returned will be inspected by Signature for signs of usage, tampering,
exchanged parts, scratches, dirt/debris, alterations or other signs of use.
·
If
you received an incorrect or defective item, etc. Signature will reimburse you
for the return shipping costs and take corrective action to fix the error.
To return
an item, please contact Customer Support at 949-580-3640 or email CustomerService@scsmail.com to
obtain an RGA number before returning any items to Signature. A mailing address
and additional instructions will be sent to you after calling technical support
for your RGA number. To ensure a quick and accurate credit, please print any
forms presented to you, and attach the paperwork to your return. You should
expect to receive your credit within 10 to 15 business days after we receive
the product back.
Receiving an
RGA Number from Signature is in no way is validation that Signature approves
parts as a warranty or non warranty issue, this is purely a tracking component
to track parts returned to Signature and the issues as they are claimed by the
customer, buyer, or end user.
Some parts are
not returnable, even within the 30 days. A non-returnable part is identified as
such in the product description and was identified when you placed the order.
It is the manufacturer’s option and Signature Control Systems Inc option to
either repair or replace the defective product at their discretion.
Signature
products purchased via the Signature-DPOP cannot be returned to a local
distributor or any other retailer that carries our products. They must be
returned back to Signature directly.
Delivery Delays
Signature are not responsible for delivery delays due to inclement
weather, government restrictions or other acts of nature. Signature will not
refund delivery charges for these types of delays. Delivery delays can happen,
and delivery estimated ship times are given in good faith. Order confirmation
and shipping information can be obtained online if you have a valid Signature
account.

Manuals can be
downloaded online free of charge.
Backorders & Partial
Shipments
Any backorders will
be shipped prepaid or charged as qualified by the original order and made via
the most economical shipping courier of Signature choice. Buyer agrees to
accept partial shipments and pay for Product comprising a partial shipment
provided.
Payment &
Cancellations
Signature-DPOP orders
are only made available to registered Signature customers who have open account
and that are in good standing with Signature.
Cancellation of orders can be done by calling customer service at
(949)580-3640. Please have your order number ready. All cancellations need to
be prior to shipping the product. Orders that are already shipped will need to
be returned using the RMA process.
Price Discrepancies
All claims for price
discrepancies must be submitted in via email at CustomerService@scsmail.com to Signature Control Systems Inc
within seven (7) days of receipt of the original order confirmation.
Privacy Information
The information
collected on the Signature web site or Signature-DPOP is used by Signature
strictly to in accordance with our Privacy Policy. We do not sell, lease, rent,
loan or transfer any personal information regarding our customers to any third
parties. We will maintain the confidentiality of your personal identity
information.
We may disclose this information if we believe that we are required to do so by
law, government or court order, subpoena or other legal process. For more

Tax
Sales tax will be
added to Signature-DPOP orders for delivery address in California. Signature-DPOP
orders are only made available to registered Signature customers who have open
account and that are in good standing with Signature.
Warranty
Warranty periods for
Signature branded products commence as of the day of the invoice. Signature will repair or replace at no
charge any Signature professional product that fails in normal use within the
warranty period stated below.

SCS INVOICE DATE.

COMMERCIAL
CONTROLLERS: TWO (2)
YEARS; CALCULATED FROM ORIGINAL SCS INVOICE DATE.
•
GOLF
SATELLITE CONTROLLERS: THREE
(3) YEARS; CALCULATED FROM ORIGINAL SCS INVOICE DATE.
•
GOLF
GEAR DRIVE ROTOR’S & VALVES: THREE
(3) YEARS; CALCULATED FROM ORIGINAL SCS INVOICE DATE.
•
BRASS
QUICK COUPLER VALVE BODIES: FIVE
(5) YEARS; CALCULATED FROM ORIGINAL SCS INVOICE DATE.
•
SOLENOID
COILS: ONE (1) YEAR; CALCULATED FROM
ORIGINAL SCS INVOICE DATE.
•
ALL
SOFTWARE, DATA SERVICES, SMART-PHONE APPLICATIONS: THREE (3) MONTHS; CALCULATED FROM
ORIGINAL SCS INVOICE DATE. EXCLUDING THE WARRANTY STATEMENT ABOVE, ALL
SOFTWARE INCLUDING DESKTOP VERSIONS, WEB VERSIONS, WEBSITE/S, WEB PORTALS, SOFTWARE AND DEVICE
FIRMWARE AND THE SERVICES ARE PROVIDED
ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH
ALL FAULTS AND WITHOUT
WARRANTY OF ANY KIND.
•
NON-PROPRIETARY
& 3RD PARTY PRODUCTS: IN THE CASE OF
ANY COMPONENTS OR PRODUCTS MANUFACTURED BY OTHERS AS NOTED ON ANY THE SIGNATURE
DOCUMENTATION PREVIOUSLY PUBLISHED AND PROVIDED, THERE IS NO WARRANTY PROVIDED
BY SIGNATURE AND THESE ITEMS ARE COVERED SOLELY BY AND TO THE EXTENT OF THE
WARRANTY IF ANY, OFFERED BY THOSE OTHER MANUFACTURERS.
You must return any Signature
professional product that fails to Signature directly. Product failures due to
acts of God including without limitation, lightning and flooding, are not
covered by this warranty. It
is the manufacturer’s option and Signature Control Systems Inc option to either
repair or replace the defective product at their discretion. Signature Control
Systems Inc. or any of its subsidiaries shall not be held liable for product
warranties other than those provided by the individual product manufacturer,
nor shall Signature Control Systems Inc or any of its subsidiaries be held
responsible for loss of wages, damages whether direct or indirect, shipping
cost or other expenses that may have been incurred from the loss of the
warranty product or the replacement time incurred by the manufacturer.
Any abuse, misuse, modification, improper packaging or attempted modification
of product/s (except with prior authorization from Signature) will void any and
all warranty. Products serial numbers or date codes that have been defaced or
altered or removed are not covered under warranty. This commitment to repair or replace is
our sole and total warranty.
THE FOREGOING TERMS AND CONDITIONS CONSTITUTE SIGNATURE'S ENTIRE
PRODUCT WARRANTY POLICY. THIS POLICY IS EXCLUSIVE AND IN LIEU OF ANY OTHER
WARRANTIES WHATSOEVER, WHETHER EXPRESS, IMPLIED, OR STATUTORY INCLUDING THE
IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE,
WHICH ARE ALL HEREBY EXPRESSLY DISCLAIMED. THE SOLE REMEDY UNDER THIS POLICY
SHALL BE LIMITED TO THE REPAIR OR REPLACEMENT OF THE PRODUCT OR ITS COMPONENTS
PURSUANT TO THE TERMS AND CONDITIONS CONTAINED HEREIN.
SIGNATURE SHALL NOT BE LIABLE TO THE CUSTOMER OR ANY OTHER
PERSON OR ENTITY FOR ANY LIABILITY, LOSS, DELAY OR DAMAGE CAUSED OR ALLEGED TO
BE CAUSED, DIRECTLY OR INDIRECTLY, BY ANY USE, DEFECT, FAILURE OR MALFUNCTION
OF THE PRODUCT OR BY THE IRRIGATION SYSTEM WHETHER A CLAIM FOR SUCH LIABILITY,
LOSS, DELAY OR DAMAGES IS BASED UPON WARRANTY, CONTRACT, TORT OR OTHERWISE. SIGNATURE
SHALL NOT BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL, COLLATERAL OR INDIRECT
DAMAGES OR DELAY OR LOSS OF PROFIT OR LOSS OF USE OR ANY DAMAGES RELATED TO THE
CUSTOMER’S BUSINESS OPERATIONS, NOR FOR THOSE CAUSED BY ACTS OF NATURE. IN NO
CASE AND UNDER NO CIRCUMSTANCES SHALL SIGNATURE'S LIABILITY EXCEED THE SIGNATURE
CORPORATION’S NET SALE PRICE OF THE PRODUCTS.
Laws concerning
customer warranties and disclaimers vary from state to state, jurisdiction to
jurisdiction, province to province or country to country and therefore some of
the foregoing limitations may not apply to you. The exclusions and limitations
set out above are not intended to, and should not be construed so as to
contravene mandatory provisions of applicable law. If any part or term of this
Policy is held to be illegal, unenforceable or in conflict with applicable law
by a court of competent jurisdiction, the validity of the remaining portions of
this Policy shall not be affected, and all rights and obligations shall be
construed and enforced as if this Policy did not contain the particular part or
term held to be invalid.
Trademark Disclosure
Product names, logos,
brands, and other trademarks featured or referred to within the Signature-DPOP
are and remain the property of their respective trademark holders, and are used
only to directly describe the products being provided. Their use in no way indicates any
relationship between Signature Control Systems, Inc, and the holders of said
trademarks.
These trademark holders are not affiliated with Signature Control Systems, Inc,
the Signature-DPOP, or our products, nor do they sponsor or endorse the Signature-DPOP
or any of our online solutions.
No infringement of any kind is intended, trademarks are used only where their
absence would render the statement ineffective.
